Nara Recorder Usage Policy

By downloading, installing, accessing, or otherwise using the Nara Recorder application (the "Application") on your iOS device, you agree to be bound by the following terms and conditions (the "Usage Policy"). If you do not agree with these terms, you must not download, install, or use the Application.

License Grant

Subject to your compliance with this Usage Policy and the App Store Terms and Conditions, Nara Recorder grants you a limited, non-exclusive, non-transferable, revocable license to use the Application solely on an Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the App Store Terms and Conditions ("Usage Rules"). You may not:

• Copy, modify, reverse engineer, decompile, disassemble, or create derivative works of the Application except as permitted by applicable law;
• Distribute, sell, rent, lease, or sublicense the Application to any third party;
• Enable or facilitate others to copy or distribute the Application.

User Responsibilities

You are solely responsible for:

• Maintaining the security of your iOS device and any Apple ID used to access the Application;
• Creating and maintaining independent backups of all data recorded, stored, or managed within the Application;
• Complying with all applicable laws and the Usage Rules when using the Application.

Data Backup and Loss

It is your sole responsibility to maintain independent backups of all data that you record, store, or manage using the Application. The Application does not provide automatic backup functionality. You acknowledge and expressly agree that:

• Data stored within the Application may be lost due to device failure, software crashes, iOS updates, device restoration, deletion, or other circumstances beyond our control;
• We are not responsible for any loss, destruction, corruption, alteration, or unavailability of data stored within the Application, whether such loss occurs due to software crashes, device failure, iOS system operations, user error, or any other cause.

Disclaimer of Warranties and Limitation of Liability

The Application is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by applicable law:

• In no event shall Nara Recorder, its developers, officers, employees, or agents be liable for any indirect, incidental, special, punitive, or consequential damages—including but not limited to loss of data, loss of profits, business interruption, or any other commercial damages—whether based on contract, tort, strict liability, or other legal theory, even if advised of the possibility of such damages;
• In no event shall Nara Recorder's total liability to you exceed one hundred dollars ($100.00).

iOS-Specific Provisions

• You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application;
• In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application (if applicable) to the maximum extent permitted by applicable law. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be handled solely by Nara Recorder in accordance with this Usage Policy;
• You acknowledge that the Application is not intended for use in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control systems, life support machines, or other equipment in which the failure of the Application could lead to death, personal injury, or severe physical or environmental damage.

Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term(s) of this Usage Policy. Upon termination, you must cease all use of the Application and delete all copies of the Application from your iOS device.

General Provisions

This Usage Policy, together with the Apple App Store Terms and Conditions, constitutes the entire agreement between you and Nara Recorder regarding your use of the Application. If any provision of this Usage Policy is found to be unenforceable, the remaining provisions shall remain in full force and effect. Nara Recorder's failure to enforce any provision of this Usage Policy shall not constitute a waiver of that or any other provision.

This Usage Policy shall be governed by the laws of the Province of Québec, Canada, excluding its conflict of laws principles.
